We expressly disclaim any liability for any loss, damage, or inconvenience you may suffer as a result of service interruptions, connection failures, data loss, or any other issues related to your use of the eSIMs.

To the fullest extent permitted by law, Roamable, its officers, directors, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use or inability to use the service, including but not limited to lost profits, loss of data, or business interruption.

You agree that your sole and exclusive remedy for dissatisfaction with the service is to discontinue use and seek any remedy from the carrier or service provider, not from Roamable.

14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Roamable, its affiliates, officers, directors, employees, agents, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from your:

  • use of and access to the service;

  • violation of these Terms;

  • violation of any third-party rights, including intellectual property or privacy rights;

  • any claim that your use of the service caused damage to a third party.

15. TERMINATION
These Terms remain effective unless terminated by either party. You may terminate these Terms at any time by ceasing to use our services. We may terminate this agreement if you violate any Terms.

19. RESELLER ROLE AND RISK ALLOCATION

Roamable operates solely as a reseller of eSIM access and does not provide wireless service directly. All wireless service is delivered by third-party carriers contracted via eSIMAccess, our upstream provider. Roamable does not guarantee or warrant the quality, availability, or coverage of the wireless service and is not responsible for any defects, outages, or interruptions of service.

You acknowledge and agree that:

  • Roamable is not liable for any loss, damage, or expenses arising from your use or inability to use the eSIM service;

  • Roamable disclaims any liability related to cyber incidents, data breaches, or unauthorized access that may affect the eSIM service or your account;

  • Roamable carries no responsibility for errors, omissions, or professional mistakes (professional liability), nor for any general liability claims arising from your purchase or use of the service;

  • Your sole recourse for service issues lies with the carrier or service provider delivering the wireless service;

  • You assume all risk for your use of the service and agree to hold Roamable harmless from any claims or damages.
